Alfred Formation – A Qualiopi-certified vocational training organisation.

Article 1 – Purpose and scope

These General Terms and Conditions of Sale (GTC) govern all contractual relations between ALFRED FORMATION, a vocational training organisation, and any client wishing to benefit from its training services.

They apply to any order placed with ALFRED FORMATION, whether from a company, a tradesperson, a self-employed person or any other client. Any order implies unreserved acceptance of these GTC.

ALFRED FORMATION reserves the right to amend these terms at any time. The applicable Terms and Conditions are those in force on the date the training agreement is signed.

ALFRED FORMATION is Qualiopi-certified for training activities within the meaning of Article L. 6313-1 of the Labour Code (Law No. 2018-771 of 5 September 2018 – Article L. 6323-17-6). The certificate is available for download.

Article 3 – Services offered

ALFRED FORMATION offers continuing professional development courses for employees, managers, craftspeople and jobseekers, organised around four areas of expertise:

  • Management and sales
  • Communication and marketing
  • Health and safety
  • Food sector

Training courses may take place face-to-face at the client’s or the trainer’s premises, in accordance with the terms set out in the training agreement. In-house training courses are available directly at the client company’s premises.

Article 4 – Registration and booking process

4.1 – Needs Assessment

Every training programme begins with a telephone or face-to-face discussion enabling ALFRED FORMATION to identify the client’s needs and to propose a programme tailored to their objectives and the requirements of their business.

4.2 – Preliminary Audit

A telephone or face-to-face audit may be carried out by the trainer in order to clarify training needs, adjust the programme and set the session dates.

4.3 – Training Agreement

In accordance with Article L. 6353-2 of the Labour Code, all training services are subject to a training agreement signed by both parties before the start of the programme. The agreement specifies, in particular: the title and objectives of the training, the programme, the duration, the dates and venues, the teaching methods, the fees and the payment terms.

The client’s signature on the agreement constitutes acceptance of these General Terms and Conditions, the privacy policy and the internal regulations of ALFRED FORMATION.

Article 5 – Fees and payment terms

5.1 – Fees

Training course fees are quoted in euros excluding VAT (HT). ALFRED FORMATION is exempt from VAT under Article 261-4-4° of the General Tax Code, in its capacity as a continuing professional development organisation.

Prices are available on the alfred-formation.fr website and will be provided on request by telephone or email. ALFRED FORMATION undertakes not to exert any unfair pressure regarding pricing.

5.2 – Invoicing

An invoice is issued upon completion of the training course or in accordance with the terms agreed in the contract. Where costs are covered by an OPCO, the invoice is sent directly to the funding body, subject to approval of the application.

5.3 – Payment Terms

Payment is to be made by bank transfer, cheque or any other method agreed between the parties, in accordance with the terms specified in the training agreement. Where funding is provided in part by an OPCO, the balance payable by the client is due under the same terms.

5.4 – Late payment

In accordance with Law No. 92-1442 of 31 December 1992 and Article L. 441-10 of the Commercial Code, any late payment shall automatically give rise to the application of late payment penalties calculated at the statutory rate in force, as well as a fixed compensation fee of €40 for recovery costs.

Article 6 – Funding by OPCOs

ALFRED FORMATION assists its clients in preparing funding applications for submission to their OPCO (skills operator). The training agreement and the funding application are drawn up and submitted by ALFRED FORMATION to the relevant OPCO, once signed by the client.

In the event that the OPCO refuses to cover the costs, or only covers part of them, the remaining balance remains payable in full by the client.

It is the client’s responsibility to check the eligibility criteria with their OPCO before registering.

Article 7 – Cancellation and Postponement

7.1 – Cancellation at the client’s initiative

Any cancellation must be notified in writing (by registered post or email with acknowledgement of receipt) to contact@alfred-formation.fr.

  • Cancellation more than 15 calendar days before the start of the training course: no charge.
  • Cancellation between 8 and 15 days before the start of the training course: 50% of the course fee will be charged.
  • Cancellation less than 8 days before the start of the training course or unjustified absence: the full cost of the training course will be charged.

7.2 – Postponement at the client’s request

The client may request a postponement of the training course up to 10 working days before the scheduled date, free of charge, subject to the trainer’s availability. Any request for a postponement must be made in writing.

7.3 – Cancellation at the initiative of ALFRED FORMATION

ALFRED FORMATION reserves the right to cancel or postpone a training course in the event of force majeure, the trainer’s unforeseen absence or an insufficient number of participants. The client will be informed of this as soon as possible. No compensation may be claimed from ALFRED FORMATION on these grounds.

Article 8 – Conduct of the training course and obligations of the parties

8.1 – Obligations of ALFRED FORMATION

ALFRED FORMATION undertakes to:

  • Provide qualified and certified trainers in their respective fields of expertise.
  • Design teaching materials in accordance with Article L. 6353-1 of the Labour Code.
  • Promptly inform the client of any factor likely to hinder the achievement of the learning objectives.
  • Issue each trainee with a certificate of completion stating the objectives, nature and duration of the course, and the results of the assessment of learning outcomes.
  • Conduct a satisfaction survey within one or two months of the end of the training.

8.2 – Client’s obligations

The client undertakes to:

  • Provide all the information necessary for the smooth organisation of the training (list of participants, specific requirements, etc.).
  • Ensure that trainees are actually present at the scheduled sessions.
  • Provide a suitable venue for the training course when it takes place on their premises.
  • Comply with, and ensure that trainees comply with, ALFRED FORMATION’s internal regulations.

Article 9 – Assessment and Monitoring

ALFRED FORMATION assesses trainees’ learning outcomes throughout the training course, in accordance with the procedures set out in the teaching programme (questionnaires, role-plays, practical workshops, self-assessment tests). A review and a follow-up plan may be carried out after the training course to measure the impact of the learning.

Article 10 – Intellectual Property

All teaching materials and documents provided as part of the training courses (booklets, presentations, practical guides, etc.) are the exclusive property of ALFRED FORMATION. They are produced on the basis of research and professional experience and are protected by intellectual property law.

Any reproduction, distribution, adaptation or use for purposes other than the training course attended is strictly prohibited without the express written consent of ALFRED FORMATION, on pain of legal proceedings for infringement (Articles L. 335-2 et seq. of the Intellectual Property Code).

Article 11 – Confidentiality

ALFRED FORMATION undertakes to keep confidential all information, comments and data provided to it by clients in the course of its work. This duty of confidentiality applies to all ALFRED FORMATION staff and trainers.

Respect for individual clients is guaranteed through the application of ALFRED FORMATION’s personal data protection policy, which complies with the GDPR (see the privacy policy).

Article 12 – Liability

ALFRED FORMATION undertakes to use all necessary means to achieve the agreed learning objectives. Its liability is limited to an obligation of means. It shall not be held liable for the results achieved by trainees following the training, nor for any indirect or consequential loss arising from the use of the training provided.

Article 13 – Force majeure

The parties shall not be held liable for the non-performance of their contractual obligations resulting from a force majeure event within the meaning of Article 1218 of the Civil Code, in particular in the event of a pandemic, natural disaster, strike, or any other circumstance beyond their control. The party concerned shall inform the other party as soon as possible.

Article 14 – Disputes and Applicable Law

These General Terms and Conditions are governed by French law. In the event of a dispute, the parties undertake to seek an amicable solution before resorting to legal proceedings. In the absence of an amicable agreement, the dispute shall be brought before the competent courts within the jurisdiction of ALFRED FORMATION’s registered office. The reference language is French.

Article 15 – Entry into force and amendments

These T&Cs come into force upon their publication on the alfred-formation.fr website and are applicable with immediate effect. ALFRED FORMATION reserves the right to amend them at any time. The applicable T&Cs are those in force on the date the training agreement is signed.
